Terms of service

These terms are the agreement between you and WhoNamed, 151 Rue Cherie, Lavaltrie, QC J5T 3B7, Canada (support@whonamed.com). WhoNamed is operated by Eric Bilodeau, sole proprietor. They apply when you use whonamed.com, ask for a free report, or buy a plan. Our privacy policy explains how we handle personal information.

Language

These terms exist in French and in English. The French version was made available to you before you accepted. By using the English version, you confirm that you chose to be bound by it. If the two versions differ, you may rely on either one.

Who can use WhoNamed

WhoNamed is for businesses. By using it, you confirm that you are at least 18, that you use it for your business, and that you have the authority to accept these terms for your company.

What WhoNamed does

Each report asks AI services (ChatGPT, Perplexity, Gemini and Claude) buyer questions about your market. It shows whether they name your company and your competitors, and suggests fixes you can make. We ask through each AI's API. Answers in the AI apps can differ, because the apps can use things like chat history and location.

We never change your website. We suggest fixes, and you decide what to do.

What we don't promise

AI answers change often, and we don't control them. We don't promise that any AI will name your company, that it will rank you higher, or that a fix will bring you more traffic or sales. Reports show what the AIs answered when we asked. They may contain mistakes made by the AIs.

The free report

The free report comes with our newsletter. To get it, you give your email and agree to receive our newsletter and marketing emails. You can unsubscribe at any time and keep your report. The free report has the limits shown on the site. We may change or stop the free report offer at any time.

Your account

We log you in with a one-time link sent to your email. Keep access to that email secure. You're responsible for what happens in your account. Tell us right away at support@whonamed.com if you think someone else used it.

Plans and prices

  • Starter: US$39 per month.
  • Pro: US$99 per month.
  • When offered, yearly plans: Starter US$390 per year and Pro US$990 per year.

Prices are in US dollars. We add sales tax where we're required to collect it. The plan details on our pricing page are part of these terms.

Stripe processes payments. By paying, you also accept Stripe's terms for the payment.

Renewal and cancellation

Plans renew automatically at the end of each month or year, and we charge the card on file, until you cancel.

You can cancel any time in the billing portal (run by Stripe) linked from your account page. Cancellation takes effect at the end of the period you paid for. You keep access until then.

If we change a price, we email you at least 30 days before it applies to your next renewal. You can cancel before then.

If a payment fails, we and Stripe will try again and email you. If it stays unpaid, we may pause or end your plan.

Refunds and our guarantee

Our guarantee. We keep sending fixes until you get one you can act on, or your money back. If none of our fixes is one you can act on, tell us at support@whonamed.com. We'll keep sending new ones. If you still don't have one you can act on, we refund your most recent payment.

Yearly plans (when offered). Ask within 30 days of your first yearly payment and we refund the full year. This doesn't apply to yearly renewals.

Other than this, we don't refund partial months or years.

Refunds go back to the card you paid with, through Stripe.

Give a month, get a month (when offered)

When the referral program is offered, each paying customer gets a link to share. When a new company starts a paid plan through your link and its first payment clears, you each get one month of your own plan as a credit on your WhoNamed bill.

  • One credit per new company. A company that already had a paid plan doesn't count.
  • There's no limit to how many companies you can invite.
  • Credits apply only to future WhoNamed bills. They have no cash value and can't be transferred.
  • We never tell you who used your link.
  • We can refuse or cancel credits obtained by fraud or abuse, such as self-referrals or fake accounts. We can change or end the program for the future. Credits you already earned stay valid.

Acceptable use

You agree not to:

  • break the law, or use WhoNamed to harass anyone or to make false claims about a competitor;
  • give us information you don't have the right to share;
  • try to get into accounts, systems or data that aren't yours, or test our security without our written OK;
  • overload the service, get around limits, or create several accounts to get more free reports;
  • copy, scrape or resell the service or reports as your own product without our written OK;
  • use reports to make fake reviews or misleading content.

We may suspend or close an account that breaks these rules. If it's not urgent, we warn you first.

Your information and our service

You keep all rights to what you give us, such as your website address and the competitors and questions you enter. You let us use it only to run WhoNamed for you, as our privacy policy describes.

Your reports are yours to use in your business, including sharing them inside your company or with your advisers. If you turn on a share link, anyone with the link can see the report until you turn the link off.

WhoNamed, its software, design and report format belong to us. These terms don't give you any rights to them beyond using the service.

Confidentiality

We keep private who our customers are and which competitors and questions each customer tracks. We only share this with the service providers we need to run WhoNamed, as our privacy policy describes, or when the law requires it.

Reviews

We only publish a review from you if you say yes. You choose whether your name or company appears. You can ask us to take it down at any time.

Liability

We provide WhoNamed "as is". We do our best to keep it running and accurate, but we don't promise it will always be available or free of errors.

As far as the law allows:

  • We are not liable for lost profits, lost sales, lost data or indirect damages.
  • Our total liability for any claim related to WhoNamed is limited to what you paid us in the 12 months before the claim.

Nothing in these terms limits our liability for bodily or moral injury, for intentional or gross fault, or for anything else the law doesn't allow us to limit.

Ending this agreement

You can stop using WhoNamed and close your account at any time by writing to support@whonamed.com. Cancel any paid plan first, in the billing portal.

We can end your access if you seriously or repeatedly break these terms. We can also stop offering WhoNamed. If we stop it for reasons other than a breach, we give you at least 30 days' notice and refund any unused prepaid time.

Changes to these terms

We may update these terms. We post the new version with a new date. If a change matters for paying customers, we email you at least 30 days before it takes effect. If you don't agree, you can cancel before it applies. If you keep using WhoNamed after that, the new terms apply.

Governing law

These terms are governed by the laws of Quebec and the federal laws of Canada that apply there. Any dispute goes to the courts of Quebec.
